1. Purpose and scope

This disclaimer applies to photographs, previews, captions, catalogue records, collection pages, search results, metadata and editorial commentary published through Archive.London.

Archive.London is operated by 825 Ventures Ltd, company number 16706831, registered office 128 City Road, London, United Kingdom, EC1V 2NX. Archive.London is the home of the Robert Harper Photograph Library.

The archive records aspects of fashion, portraiture, society, design, advertising, travel, culture, commerce, industry and modern life. Its photographs may depict or refer to identifiable people, public figures, private individuals, companies, brands, products, packaging, logos, trade marks, publications, artworks, buildings, interiors, events, venues, objects and other material in which third-party rights or interests may subsist.

This page explains the capacity in which that material appears, the limits of the information provided and the distinction between archival display and licensed downstream use.

2. Archival, artistic, documentary and editorial presentation

Photographs are displayed on Archive.London primarily for archival, artistic, documentary, historical, cultural, educational, research, cataloguing and editorial-reference purposes. Their public presentation records and interprets a body of photographic work and allows editors, researchers, institutions, rights holders and prospective licensees to understand what the archive contains.

The public display of a photograph on Archive.London is not itself an advertisement for a depicted person, brand, product or service. It is not a representation that the depicted subject commissioned, approved, sponsored, endorsed or is affiliated with Archive.London, 825 Ventures Ltd or the Robert Harper Photograph Library.

Archive.London is a commercial archive and accepts licensing enquiries. For that reason, we do not inaccurately describe the website as wholly non-commercial. The correct distinction is that public catalogue and editorial display does not, without more, amount to a commercial endorsement by a depicted subject. Any later advertising, promotional, merchandising or other commercial use of an image requires a separate written image licence and may require additional third-party permissions.

3. No endorsement, sponsorship or affiliation

Unless an Archive.London page expressly states otherwise on the basis of verified evidence:

  • No person, estate, representative, company, brand, publication, institution, venue or rights holder has sponsored, endorsed or approved Archive.London.
  • No person or organisation depicted or named is represented as a client of Archive.London or 825 Ventures Ltd.
  • No reference to a publication in which Robert Harper's work appeared implies that the publication endorses the present archive or website.
  • No reference to a photographer whom Robert Harper assisted implies a present partnership, representation, endorsement or approval by that photographer or estate.
  • No photograph depicting a branded object establishes that the photograph was commissioned by the brand.
  • No archive category or brand page represents itself as an official brand archive, authorised catalogue or definitive corporate history.

Any authorised relationship, original commission, publication history or client connection will be stated only where supported by records considered sufficient for publication.

4. Trade marks, logos and brand names

All third-party trade marks, service marks, trade names, logos, product names, get-up, packaging and other brand identifiers remain the property of their respective owners.

Their appearance on Archive.London is descriptive and referential. They may identify what is visibly depicted, assist archive search, describe historical context or reproduce a mark incidentally present in a photograph. Archive.London does not claim ownership of third-party marks and does not use them to misrepresent the commercial origin of the website or its services.

The use of a brand name in a page title, heading, URL, caption, metadata field or search index is intended to identify relevant archive material accurately. It does not imply authorisation, partnership, dealership, sponsorship, endorsement or that the page is maintained by the trade-mark owner.

Brand and product identification may sometimes be provisional. A visible mark may be incomplete, historical, altered, stylised or incorrectly recorded in an earlier inventory. Users must not treat a catalogue label as a current brand statement or product-authentication opinion.

If a rights holder believes a mark has been misidentified, used in a misleading manner or presented without necessary context, it may submit evidence under our Rights Claims, Takedown and Corrections Policy.

5. People, public figures and private individuals

The appearance or naming of a person does not imply consent to every present or future use of the photograph. It does not imply endorsement of Archive.London, the photographer, the archive's present owner, a licensee, a product, a service, an opinion or a cause.

Photographs may record people in professional, public, social, editorial, studio, travel, event or everyday settings. Some identities derive from historic catalogue information and may remain under review. Unless expressly confirmed, Archive.London does not warrant that a person has been conclusively identified.

The fact that an individual is well known does not remove privacy, data-protection, confidentiality, defamation or other legal considerations. The fact that an individual is not well known does not mean that a photograph lacks artistic, historical, journalistic or archival significance.

Archive.London considers the context, age, sensitivity, public availability, archival value, freedom of expression, potential harm and applicable legal rights when deciding whether and how material should be displayed. Additional caution applies to children, health-related contexts, intimate circumstances, allegations of wrongdoing and other potentially sensitive material.

Nothing on Archive.London should be read as alleging a person's conduct, beliefs, health, sexuality, religion, politics, finances, criminality or other sensitive characteristic merely because of the category in which an image appears, objects visible in the frame, nearby editorial text or links to related archive material.

6. No model, property or trade-mark release implied

Unless a written statement issued by 825 Ventures Ltd expressly confirms otherwise, Archive.London does not represent or warrant that it holds:

  • A model release from every identifiable person.
  • A property release for every building, interior, artwork, object or location.
  • Trade-mark consent from every brand owner.
  • Publicity, personality or endorsement consent.
  • Permission covering every artwork, design, publication, performance or other third-party work visible in an image.
  • Clearance for advertising, promotion, merchandising, packaging or other commercial association.

Copyright in a photograph is legally distinct from rights or interests connected with its subject matter. Control of photographic copyright does not necessarily confer every permission required for every proposed use.

7. Commercial use requires separate assessment

An Archive.London image licence grants only the photographic copyright permission expressly described in the written Licence Confirmation. It does not silently grant third-party permissions.

A prospective licensee is responsible for explaining its intended use accurately and assessing whether further permissions, releases or legal review are required. This is especially important for:

  • Advertising and promotional campaigns.
  • Product endorsement or implied endorsement.
  • Packaging and point-of-sale use.
  • Merchandise and products for resale.
  • Political, religious or campaigning material.
  • Sensitive subjects or potentially defamatory juxtapositions.
  • Health, medical, financial, criminal, sexual or behavioural implications.
  • Composite, manipulated, colourised or generative uses.
  • Uses placing words in the mouth of a depicted person.
  • Uses of artworks, designs, trade marks or branded products as prominent creative elements.

Archive.London may decline a licence, require a proposed layout, impose contextual restrictions, require evidence of clearances or refer a licensee to its own legal advisers. Providing factual archive information or discussing a proposed use is not legal advice and is not a warranty that the use is lawful.

8. Editorial use is not unlimited use

Describing a use as editorial, documentary, artistic, educational or non-commercial does not automatically make it lawful and does not create an image licence.

The legal position depends on the facts, including the material used, purpose, extent, context, accuracy, audience, rights involved and any applicable statutory exception. Users must obtain a licence from Archive.London where photographic copyright permission is required and must obtain any additional permission required for their own use.

A charity, school, researcher, social-media user, fan account or non-profit organisation is not automatically exempt from copyright or other rights. Lack of revenue does not by itself authorise copying.

9. Historic captions, inventory language and evolving research

Archive records may derive from historic captions, handwritten notes, contact sheets, file names, envelopes, transparencies, inventory descriptions, working titles, publication references and visual assessment.

The language of an original record may be incomplete, dated, ambiguous or wrong. Archive.London may modernise, qualify or correct public descriptions while preserving the original record internally for research and audit purposes.

The following expressions carry their ordinary cautionary meaning and form a material part of the description:

  • Catalogued as means the description appears in an archive or inventory record but may not have been independently verified.
  • Believed to be means available evidence supports an attribution that remains uncertain.
  • Associated with means a connection is recorded or suggested but is not necessarily proof of ownership, commission, attendance or endorsement.
  • Attributed to means authorship, identity or origin is not treated as conclusive.
  • Unidentified means Archive.London has not confirmed the subject.
  • Date unknown or circa means the date is absent or approximate.

Users, search engines and automated systems must not omit those qualifications when repeating the information.

10. Celebrity, ownership and personal-property claims

An inventory may describe an object as belonging to, used by, associated with or connected to a named person. Such descriptions are catalogue leads and not certificates of authenticity, title, ownership or screen use.

Unless a page expressly states that documentary provenance has been verified, Archive.London does not warrant that a depicted object was owned, worn, used, commissioned or authorised by the named person. Visual resemblance, a historic label or inventory shorthand is not by itself conclusive evidence.

Potential licensees, auctioneers, publishers, insurers and researchers must undertake their own due diligence before relying on an association for commercial, valuation, authentication or publication purposes.

11. Products, artworks and designs

The depiction of a product does not amount to a warranty of authenticity, safety, condition, origin, manufacturer, model, date, market value or regulatory compliance.

The depiction of an artwork, design, poster, book, record sleeve, costume, building or other creative work may involve rights separate from copyright in the photograph. Archive.London does not grant those separate rights unless a written agreement expressly says so.

No page is evidence that a product was approved by its manufacturer, that an artwork was authenticated by its creator or estate, or that an object is suitable for sale.

12. Events, venues and places

An image associated with an event, venue or place does not necessarily establish the precise date, official event title, organiser, address or permission status. A location may be recorded according to the photographer's working description or later inventory.

The presence of an image does not imply endorsement by a venue, landowner, event organiser, public authority or local community.

13. Publications and professional history

References to Vogue, Tatler, Cosmopolitan, Esquire, The Face, Wallpaper, Harpers & Queen, Elle, The Telegraph Magazine, Condé Nast and other publications describe documented aspects of Robert Harper's career or the context of archive material.

References to David Bailey, Helmut Newton and Lester Bookbinder describe Robert Harper's documented experience assisting them during his time at Condé Nast. Archive.London does not state or imply that those individuals, their estates or representatives endorse, sponsor, approve or are presently affiliated with Archive.London or 825 Ventures Ltd.

Search results, tags, categories, automated relationships and related links are discovery aids. Their proximity does not necessarily imply a legal, commercial, personal or historical relationship.

For example, a photograph may appear on a brand page because a product is visible, on a place page because the location is recorded, and on a people page because a person is catalogued. Those classifications do not prove a commission, endorsement, ownership relationship or attendance at a particular event.

Archive.London should use human-reviewed relationships for sensitive subjects and must correct materially misleading automated associations when identified.

15. Artificial intelligence and automated summaries

Search engines and artificial-intelligence systems may extract, summarise or combine public information in ways outside Archive.London's control. A third-party generated summary is not an official Archive.London statement unless it reproduces the canonical page accurately.

Automated systems must preserve provenance qualifications, credit and context. Technical access to a page does not grant permission to train a model, build a dataset, reproduce photographs or republish protected content.

Archive.London is not responsible for an inaccurate answer, snippet, caption or association generated by an unaffiliated search engine, platform or artificial-intelligence provider. We will, where practical, correct our own source page if it is inaccurate and may request correction by the third party.

16. Freedom of expression, archive stewardship and competing rights

Archive stewardship may require a careful balance between copyright, privacy, data protection, reputation, freedom of expression, historical record, artistic value and the public interest. No single factor determines every case.

Archive.London does not claim that the words artistic, editorial, historical or archival create an automatic exemption from law. They describe the genuine purpose and context of the presentation and are factors to be assessed alongside the rights and circumstances involved.

Requests concerning public display are considered individually under the Rights Claims, Takedown and Corrections Policy.

17. No waiver and no admission

Publishing this disclaimer does not waive any copyright, database right, contractual right, moral right, trade mark, remedy or defence held by 825 Ventures Ltd or another rights holder.

Adding a qualification, correcting a caption, restricting access or temporarily removing material during review is not an admission of liability, infringement, inaccuracy or wrongdoing.

Failure to identify a third-party right on a page does not mean that no such right exists. Users remain responsible for the legal assessment of their own proposed use.

18. Reporting a concern

People depicted, authorised representatives, brand owners, estates, venues, rights holders and researchers may raise a concern by emailing info@825ventures.online with:

  • The exact Archive.London URL.
  • The image or wording concerned.
  • The nature of the right or correction asserted.
  • The requester's connection to the subject or right.
  • Supporting evidence.
  • The outcome requested.
  • Any genuine urgency or safety issue.

Archive.London will assess the request under its Rights Claims, Takedown and Corrections Policy. A request does not automatically establish identity, ownership, infringement, a right to removal or a right to control historical reporting.
